These terms explain how we sell to you. They apply to every order you place on cutandcrimp.co.uk. Please read them before you order. If you do not understand something, email info@hudsonmarine.co.uk or call 023 8045 5129 and we will explain it.
1. Who we are
The seller is Oranworth Limited, trading as Cut & Crimp (part of Hudson Marine Electronics). In these terms, "we", "us" and "our" mean Oranworth Limited and "you" means the person placing the order.
Contact: info@hudsonmarine.co.uk, 023 8045 5129 (Monday to Friday, 9am to 5pm). Address: Cut & Crimp, Mercury Yacht Harbour, Satchell Lane, Hamble, Hampshire, SO31 4HQ.
2. What we sell
We sell battery cable, terminals, lugs, fuses, fuse holders, busbars, heat shrink, tools, glands, cable ties and leads made to your measurements. We supply products only. We do not offer installation or fitting services.
We take care to describe and photograph our products accurately, but colours on screen can vary slightly. Cable sizes, current ratings and other technical information on our site and in our calculator are there to help you choose. You are responsible for checking that what you order suits your application, including the correct cable size, terminal size and fuse protection. If you are unsure, ring us before you order.
3. Placing an order and our contract with you
When you place an order you are making us an offer to buy. We accept your order, and a binding contract is formed, when we email you to confirm that we have dispatched it or that it is ready for collection. We may decline an order, for example if an item is out of stock, if there is an obvious pricing or description error, or if we cannot deliver to your address. If we decline an order or cannot fulfil part of it, we will tell you and refund anything you have paid for the part we cannot supply.
Our automatic order confirmation email acknowledges that we have received your order. It does not by itself mean we have accepted it.
4. Prices and payment
Prices are in pounds sterling (GBP). The total you pay, including any delivery charge and any taxes that apply, is shown at checkout before you confirm your order. Payment is taken at checkout through Shopify's secure payment service. We never see or store your full card details.
If we find a pricing error after you have ordered, we will contact you. You can then either confirm the order at the correct price or cancel it for a full refund.
5. Made-to-measure leads and cut cable
Any assembly you configure yourself, and any cable cut to a length you specify, is made to your specification. Please check your measurements, stud sizes and options before you order. Under regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day right to cancel does not apply to goods made to a consumer's specifications or clearly personalised. This means we cannot accept a return of a made-to-measure item because you changed your mind or measured wrong.
This does not affect your legal rights if the item is faulty, damaged or not as described. Those rights apply to made-to-measure leads in the same way as to everything else. See our refund policy for details.
6. Delivery
We deliver to addresses in the UK, the Channel Islands, the Isle of Man and the EU. Delivery is a flat £6.95 to UK addresses, a flat £14.95 to the Channel Islands and the Isle of Man, and a flat £49.99 to EU addresses. Pallet and heavy carriage is quoted separately. Dispatch times and arrangements for heavy parcels and pallets are set out in our shipping policy, which forms part of these terms. Delivery estimates are not guaranteed. If we have not delivered within 30 days of your order, or by a later date we have agreed with you, you can ask us to cancel the order and refund you.
Risk of loss or damage to the goods passes to you when the goods are delivered to you or to someone you nominate. You own the goods once we have received payment in full.
7. Your right to cancel and return goods
If you are a consumer, you have the right to cancel an order for stock items within 14 days of receiving the goods, without giving a reason. How to cancel, how to return goods and how refunds work are set out in our refund policy, which forms part of these terms. The right to cancel does not apply to made-to-measure leads (see section 5) or to purchases made as a business.
8. Faulty, damaged or incorrect goods
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have legal rights to a refund, repair or replacement. Nothing in these terms limits those rights. Please see our refund policy for how to contact us and what to expect.
9. Our responsibility to you
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
If we break these terms or fail to use reasonable care and skill, we are responsible for the loss or damage you suffer that is a foreseeable result of our doing so. Loss is foreseeable if it was an obvious consequence of our breach or if you and we both knew it might happen when you placed your order.
We supply goods for domestic and private use as well as for trade. We are not liable for loss of profit, loss of business or business interruption if you buy as a business. If you buy as a business, our total liability to you for any order is limited to the price you paid for that order.
We are not responsible for delays or failures caused by events outside our reasonable control, such as courier or customs delays, severe weather or supplier failure. We will tell you as soon as we can and do what we reasonably can to reduce the effect on you.
10. Trade customers
If you buy as a business, the consumer rights described in these terms (the 14-day right to cancel and the rights in the Consumer Rights Act 2015) do not apply to you in the same way. Our refund policy explains how we handle returns from trade customers. Your rights in respect of faulty goods are unaffected.
11. Your personal information
We use your personal information as described in our privacy policy.
12. Our website and intellectual property
The content of this site, including text, images, logos and the calculator, belongs to us or our licensors. You may use it to browse and buy from us and for your own personal use, but you may not copy it or reuse it commercially without our written permission.
13. Changes to these terms
We may update these terms from time to time. The terms in force when you place your order are the ones that apply to that order.
14. General
If any part of these terms is found to be unenforceable, the rest remains in force. If we do not enforce a right straight away, that does not mean we have given it up. These terms, together with our refund policy and shipping policy, are the whole agreement between you and us about your order.
15. Complaints, governing law and courts
If you have a complaint, please contact us first at info@hudsonmarine.co.uk or on 023 8045 5129 and we will do our best to put things right.
These terms and any contract between you and us are governed by the law of England and Wales. If you are a consumer, you can bring a claim in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of the part of the UK where you live. If you buy as a business, the courts of England and Wales have exclusive jurisdiction.
